After having lost the case in Europe against the Spanish DPA and Costeja Gonzales (Google Inc. and Google Spain vs, AEPD and Costeja Gonzales) more trouble for Google. The Mexican DPA on January 27 has declared that Google Mexico has acted in violation of the local privacy law by refusing to comply with a request to erase a news. Google Mexico had claimed that the search engine was not under its control, but under Google Inc.’s control but the Mexican DPA (IFAI) has cited the Costeja Gonzales case to state that Google Mexico was responsible for violating the local privacy law. The IFAI has started a new proceedings to determine the sanction related to this violation.
